The use of this website may involve the processing of personal data. The data protection term “personal data” refers to all information relating to an identified or identifiable individual. An IP address may also constitute personal data. An IP address is assigned to every device connected to the internet by the internet service provider so that it can send and receive data. When you use the website, we collect information that you provide yourself. In addition, during your visit to the website, we automatically collect certain information about your use of the website.
If the processing of personal data is necessary and there is no legal basis for such processing, we generally seek your consent.
As the data controller, we have implemented numerous technical and organisational measures to ensure the most comprehensive protection possible of the personal data being processed.

3.Data processingand storage
The following personal data may be processed when you visit our website:
3.1 Technology
When you use our website for information purposes only, we collect only those data that are technically essential for providing the service. These are typically data that your browser transmits to our server (in so-called server log files). Every time you or an automated system accesses a page on our website, our website collects a range of general data and information. This general data and information is stored in the server’s log files. The following may be collected:
- browser types and versions used,
- the operating system used by the accessing system,
- the website from which an accessing system reaches our website (so-called referrer),
- the sub-pages accessed on our website via an accessing system,
- the date and time of access to the website,
- a truncated Internet Protocol address (anonymised IP address) and,

We do not draw any conclusions about your identity when using this general data and information. Rather, this information is required to

The anonymous data from the server log files is stored separately from any personal data provided by a data subject.
The legal basis for data processing is Article 6(1)(f) of the GDPR. Our legitimate interest arises from the purposes listed above.
3.2 Hosting by Werkbank GmbH
Our website is hosted by Werkbank GmbH, Viktoriastraße 75, 44787 Bochum. When you visit the website, your personal data is processed on Werkbank’s servers in Germany for the purpose of displaying our website in accordance with Article 6(1)(f) of the GDPR.
The use of the hosting service provider is based on a data processing agreement in accordance with Article 28 of the GDPR.
3.3 Cookies
3.3.1 General information about cookies
Cookies are small files that your browser automatically creates and which are stored on your device (laptop, tablet, smartphone, etc.) when you visit our site.
Information is stored in the cookie that relates to the specific device used. However, this does not mean that we thereby gain direct knowledge of your identity.

As part of our marketing activities, we send out digital newsletters containing information on products, events, promotions, offers, loyalty programmes or advertising from the product ranges of the MEDICE Health Family.

Our marketing activities are primarily aimed at customer retention and relationship management, sharing information, market and opinion research, improving our services, and automating communication.

We use the CRM solutions provided by salesforce.com Inc. (“salesforce”), One Market Street, Suite 300, San Francisco, CA 94105, USA. MEDICE Arzneimittel Pütter GmbH & Co. KG only uses service providers with whom a corresponding data processing agreement in accordance with Article 28 of the GDPR has been concluded.
The legal basis for the processing of your data in connection with the newsletter is your voluntary consent under Article 6(1)(a) of the GDPR.
You may withdraw your consent at any time without giving reasons and unsubscribe from the newsletter. For this purpose, a corresponding link/contact details are provided in every newsletter.
3.6 Web analytics
Matomo
We have integrated the Matomo component from the provider InnoCraft Ltd., 150 Willis St, 6011 Wellington, New Zealand, into this website. Matomo is a software tool for web analytics, i.e. for the collection, gathering and evaluation of data regarding the behaviour of visitors to websites or applications. Among other things, data is collected on which website a data subject came from to reach a website (known as a referrer), which subpages of the website were accessed, and how often and for how long a subpage was viewed. This is used to optimise the website and for cost-benefit analysis of online advertising.
The software is operated on the controller’s server; log files that are sensitive under data protection law are stored exclusively on this server.
Matomo places cookies on your IT system. The placement of these cookies enables us to analyse the use of our website. Each time the website is accessed, the Matomo component automatically prompts the web browser on your IT system to transmit data to our server for the purpose of online analysis. As part of this technical process, we obtain personal data, such as the IP address of the data subject, which we use, amongst other things, to track the origin of visitors and clicks. We do not pass this personal data on to third parties.

Microsoft Clarity
On our website, we use the web analytics service Microsoft Clarity provided by Microsoft Ireland Operations Limited, hereinafter referred to as “Microsoft”.
The Microsoft Clarity service is used to analyse the usage behaviour of our website, to compile reports on website activity, and to provide further services related to website and internet usage for the purposes of market research and the needs-based design of our website.

Appropriate contractual agreements in accordance with Article 28 of the GDPR have been concluded with the service provider on the basis of the European Commission’s Standard Contractual Clauses.

Google Analytics 4 (GA4) / Google Universal
On our website, we use the web analytics service Google Analytics provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”).
This creates pseudonymised user profiles and uses cookies (see section 3.3 “Cookies”).
The following data relating to website usage is collected from you via the cookies, amongst other things:
- IP address (temporary recording without permanent storage)
- Location data
- Browser type/version
- Operating system used
- Referrer URL (previously visited page)
- Time of the server request
The pseudonymised data may be transferred by Google to a server in the USA and stored there.
The information is used to analyse website usage, to compile reports on website activity and to provide other services relating to website and internet usage for the purposes of market research and the needs-based design of the website. This information may also be transferred to third parties where required by law or where third parties process this data on behalf of Google. Under no circumstances will your IP address be merged with other data held by Google. IP addresses are anonymised so that they cannot be linked to you (IP masking).
These processing operations take place exclusively upon your express consent in accordance with Article 6(1)(a) of the GDPR via the relevant cookie banner.
The default data retention period set by Google is 14 months. Otherwise, personal data is retained for as long as is necessary to fulfil the purpose of processing. The data is deleted as soon as it is no longer required to achieve the purpose.
The parent company, Google LLC, is a US company certified under the EU-US Privacy Shield Framework, meaning that the EU Commission’s adequacy decision pursuant to Article 45 of the GDPR applies, thereby confirming an adequate level of data protection.

3.7 Plugins and other services
salesforce
We also use the CRM solutions provided by salesforce.com Germany GmbH, Erica-Mann-Str. 31-37, 80636 Munich, Germany, for customer support and marketing activities. The CRM platform (Customer Relationship Management platform) is used for the management of customer and consent data, sales and marketing management, and to provide customer support.
When you contact customer support (via email, contact form or telephone), the following personal data may be collected and processed:
- Contact details (first name and surname, email address, telephone number)
- Communication data (content of the enquiry/correspondence)
All stored data is encrypted and subject to strict data protection guidelines in accordance with the EU General Data Protection Regulation (GDPR). Data processing takes place exclusively on servers within Germany.

3.8 Cooperation with the parent company and other subsidiaries
In order to pursue the legitimate interests of MEDICE Health Family Holding GmbH pursuant to Article 6(1)(f) of the GDPR in optimising the advertising and sales market presence of our parent company and subsidiaries, it may be necessary for us to share certain personal data within MEDICE Health Family Holding GmbH. This applies in particular to contact details, information about your interests and your customer profile, as well as your use of our products and services.
The joint processing of this data takes place within the framework of joint controllership in accordance with Article 26 of the GDPR. The companies involved within MEDICE Health Family Holding GmbH have set out in an agreement how the respective tasks and responsibilities relating to the processing of personal data are allocated and who fulfils which obligations under the GDPR.
The shared data may be used to:

3.9 Purposes of processing
Personal data is processed for the following purposes:

4.Legal basis
The legal bases for the processing of your personal data may be your informed, voluntary consent pursuant to Article 6(1)(a) of the GDPR, where applicable in conjunction with Article 7 of the GDPR; the performance of a contract to which you are a party; or the implementation of pre-contractual measures pursuant to Article 6(1)(b) of the GDPR; the fulfilment of a legal obligation pursuant to Article 6(1)(c) of the GDPR, Section 22(1)(1)(c) of the BDSG-neu and Section 63c of the AMG, or the protection of our legitimate interests or those of a third party pursuant to Article 6(1)(f) of the GDPR.
5. Data transfer
We will only disclose your personal data to third parties if:
- you have given us your explicit consent to do so in accordance with Article 6(1)(a) of the GDPR,
- the transfer is permissible under Article 6(1)(f) of the GDPR to safeguard our legitimate interests and there is no reason to assume that you have an overriding legitimate interest in the non-disclosure of your data,
- there is a legal obligation to do so under Article 6(1)(c) of the GDPR, and
- this is legally permissible and necessary under Article 6(1)(b) of the GDPR for the performance of contractual relationships with you.
As part of the processing operations described in this privacy policy, personal data may be transferred to the USA. Companies in the USA only have an adequate level of data protection if they have certified themselves under the EU-US Data Privacy Framework and the EU Commission’s adequacy decision pursuant to Article 45 of the GDPR therefore applies.
We have explicitly stated this in the privacy policy for the relevant service providers. To protect your data in all other cases, we have entered into data processing agreements based on the European Commission’s Standard Contractual Clauses. Where the Standard Contractual Clauses are insufficient to ensure an adequate level of security, your consent pursuant to Article 49(1)(a) of the GDPR may serve as the legal basis for the transfer to third countries. This does not apply, however, to data transfers to third countries for which the European Commission has issued an adequacy decision pursuant to Article 45 of the GDPR.
6. Data security
The security of your personal information is very important to us.
Every instance of data collection, storage, use and transmission involves confidentiality risks (e.g. the possibility of identifying the individual concerned). These risks cannot be completely ruled out and increase the more data can be linked together. Medigital GmbH assures you that it will do everything possible, using state-of-the-art technology, to protect your data during transmission.
To this end, we implement the following technical and organisational measures, amongst others:
- SSL/TLS encryption: Personal data is transmitted only via connections encrypted using state-of-the-art technology. We comply with the applicable guidelines of the Federal Office for Information Security and use this technology to protect the transmission of your data.
- IP anonymisation: The IP anonymisation function is enabled for this website. This means that your IP address is truncated by Google within Member States of the European Union or in other signatory states to the Agreement on the European Economic Area before being transmitted to the USA. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and truncated there. The IP address transmitted by your browser as part of Google Analytics is not merged with other Google data.
- Different passwords for all software tools
- Multi-factor authentication for access to internal systems and information
- Virus protection for all IT hardware in use
- Firewall for our internal company network
- Regular training on data security and protection for all employees
- Regular updates of all software components
- Regular data backups to ensure availability
- Regular risk analyses of the relevant IT systems
7. Your rights

You may exercise the following rights in relation to your personal data:
- You can request information about the processing of your data.
- You can request the rectification of your personal data if it is inaccurate or incomplete.
- You can request the restriction of the processing of your personal data: (1) For the duration of the verification of the accuracy of the data, (2) If the processing is unlawful and you object to erasure, (3) If the data is no longer required by the controller for the purposes of processing, but you require it for the establishment, exercise or defence of legal claims, (4) In the event of an objection to the data processing, until the relevant balancing of interests has been clarified.
- You can request that the data collected about you be transferred to you or to a party designated by you.

- You can request the erasure of the data collected about you.
- You can object to the processing of your personal data at any time, informally and without giving reasons.

You will not suffer any disadvantages as a result of an objection or withdrawal. The objection applies with effect for the future; data transfers made to date remain lawful. From now on, your data will only be processed by MEDICE Arzneimittel Pütter GmbH & Co.
